Heard learned Counsel for the Petitioner.
The Petitioner herein has challenged the order dated 15 December 2018 passed by the Industrial Court Maharashtra, Pune, in Approval Application (IT) No. 3 of 2013, whereby preliminary order was passed. The order reads as under:

1. It is hereby declared that the enquiry conducted against the opponent-employee is prima-facie legal, fair and proper, and the findings of the enquiry officer are perverse.
2. The applicant company is at liberty to justify their action, if they desires.
3. Case to proceed further.
3 The Petitioner being aggrieved by item no. 2 of the said order had approached this Court challenging the same, during the pendency of the said Application. However, today the learned Senior Counsel for the Petitioner places on record final order passed by the Industrial Tribunal, Pune dated 26 April 2023. The said order is tendered in the Court and taken on record. In view of the said order, the learned Counsel for the Petitioner seeks liberty to withdraw the Writ Petition. Liberty is granted. 4 The Writ Petition is disposed of as withdrawn. (MANJUSHA DESHPANDE, J.)
