The Applicant, apprehending his arrest in connection with the investigation of Crime No. 31 of 2022 registered with Kothrud Police Station, Dist. Pune under Section 498-A, 304-B read with Section 34 of I.P.C. and Section 3 and 4 of the Dowry Prohibition Act, is seeking pre-arrest bail.

The aforesaid crime is registered on the basis of the complaint lodged by Pornima Nalegaonkar, who is the mother of the deceased Nandini Bawadankar, who committed suicide by hanging in her matrimonial home at Pune. Accused No.1 Pavankumar Bawadankar happens to be the husband of the deceased. The present Applicant is maternal grandfather of the Sneha Chavan page 1 of 3
accused No.1. The Applicant is residing at post Shendala, Taluka Mehkar , District Buldhana while matrimonial native place of the deceased is at Washim, District Buldhana. However, the deceased along with her husband was residing at Pune where she committed suicide.

I have heard the learned counsel for the parties. Perused FIR.

Prima facie it appears that there is a general allegation insofar as the present Applicant is concerned of conspiring with father and mother of the accused No.1 (the parents-in-law of deceased) in illtreating the deceased. Prima facie, it appears that there are no specific allegations. The learned counsel for the Applicant states that the Applicant being the maternal grandfather of the husband of the deceased, was not even staying with the family of the deceased. The Applicant is stated to be 81 years old.

Considering the over all circumstances, the following order is passed:
ORDER
i) In the event of his arrest, in connection with the investigation of Crime No. 31 of 2022 registered with Kothrud Police Station, Dist. Pune, the Applicant shall be released on bail Sneha Chavan page 2 of 3
on executing a PR Bond in the sum of Rs.25,000/- with one or two solvent sureties in the like amount.
ii) The Applicant shall report to the Investigating Officer and as and when required by the Investigating Officer. iii) The Applicant shall co-operate with the Investigating Agency and shall not tamper with the prosecution evidence/witnesses.
