After hearing the learned counsel for the applicant, when this Court was not inclined to grant any relief, the learned counsel on instructions seeks leave to withdraw the present petition with liberty to advert all his contentions in the trial arising out of RCC No.315/2012. Leave and liberty granted. The applicant is at liberty to raise all the contentions which are in the form of his defence at the time of trial.

2) Since the trial pertaining to RCC No.315/2012 is ending for last about 4 years, the Learned JMFC, Vadgaon, Maval is hereby directed to expedite the trial of RCC No.315/2012 and to conclude the same on or before 31.12.2016.
