This is the third bail application preferred by the applicant seeking his enlargement on bail in connection with C.R. No. I-11 of 2017 registered by the Jawahar Police Station, Thane, for the alleged offences punishable under Sections 354(B), 506 of the Indian Penal Code and Sections 8, 9(f) and 10 of the Protection of Children from Sexual Offences Act.

Perused the papers. The first bail application of the applicant was withdrawn after arguing for some time, as the Court was not inclined to enlarge the applicant on bail. The same is recorded in the order dated 1st September 2017. However, having regard to the peculiar facts of the case, SQ Pathan 1/2

16-BA-677-2021.doc the trial of the applicant was expedited and the learned trial Judge was directed to conclude the trial as expeditiously as possible and preferably within 9 months from the date of receipt of the said order. Liberty was also granted to the applicant to file a fresh application. Pursuant thereto, the applicant filed second bail application being Criminal Bail Application No. 729/2018. The said application was rejected on merits vide order dated 7th August 2018. Learned A.P.P informs that till date, 7 witnesses have been examined and that the trial Court is giving short dates, so that, the trial can conclude expeditiously.

Considering that the trial is in progress and that 7 witnesses have been examined till date, it is expected that the trial Judge will conclude the case at the earliest. Since the trial of the applicant is already made time-bound, no separate order is required in the present application. Applicant to cooperate in the conduct of the trial. REVATI MOHITE DERE, J.
