By this application, the applicant seeks modification of clause (iii) of the order dated 25th February 2020 passed by this Court, whilst enlarging the applicant on bail.
Learned counsel for the applicant submits that the applicant has been regularly attending the concerned police station, except for two months i.e. April and May 2020, during the lock-down. He submits that 1/3
charge-sheet has been filed in the said case and that the applicant is ready to attend the concerned police station as and when called. Perused the papers. On 25th February 2020, this Court (Coram: Prakash D. Naik, J.) enlarged the applicant on bail on certain terms and conditions. One of the condition of which modification is sought, reads as under :
"9. ..........
(iii) Applicant shall attend concerned Police Station once in a month on first Saturday of the month between 11:00 a.m. to 01:00 p.m, till further order."
It appears that the applicant has been reporting to the concerned police station as directed by the aforesaid order, except in the months of April and May 2020, due to lock-down. It appears that post grant of bail to the applicant on 25th February 2020, the police have filed chargesheet in the said case. Considering the aforesaid, the application is allowed to the extent that the applicant, instead of reporting to the concerned police station once in a month on first Saturday of the month, shall now report to the 2/3
concerned police station, once in two months, on the first Saturday between 11:00 a.m to 1:00 p.m, until further orders.
Rest of the conditions imposed vide order dated 25th February 2020, to remain as it is.
Application is disposed of accordingly.
