This is an application seeking protection under Section 438 of Cr.P.C. for a period of two weeks to enable the applicant to approach the competent Court seeking appropriate reliefs.

Applicant is apprehending arrest in connection with C.R.No.436 of 2019, registered with Jadhavpur police station, Kolkata, for the ofences punishable under Sections 420 and 120B, of Indian Penal Code ("IPC", for short).

rpa 2/3 922-aba-406-2020.doc The contention of the applicants is that the applicants are falsely implicated in this case in a commercial transaction. Applicants are resident of Pune. It is also submitted that the applicants has lodged a complaint with Chief Commissioner of Police, Pune.

Learned APP submitted that the instructions were sought from the local police station, Pune, however, the oficer is not present.

Without going through the merits of the case and adjudicating the issue, to enable the applicants to approach competent Court for appropriate relief, applicants can be granted protection for two weeks.

Hence, I pass the following order:

(i) In the event of arrest of Applicants in connection with C.R.No.436 of 2019, registered with Jadhavpur police station, Kolkata, they be released on bail on their executing P.R. Bond in

(ii) This protection is granted for two weeks to enable the applicant to approach the appropriate Court at Kolkatta, seeking appropriate reliefs;

(iii) Anticipatory Bail Application stands disposed of. (PRAKASH D. NAIK, J.)
