Heard learned Counsel for the parties.

This Application is made by the plaintiff for fixing early date of hearing of Second Appeal no. 1122 of 2012 on the ground that applicant is Senior Citizen.

The learned counsel for the applicant submits that at present applicant is not pressing other prayers of the Civil Application . The statement is accepted.

Considering the submissions made by the learned counsel for the Applicant, the averments 1/3

made in the Application and as the applicant is senior citizen, I am satisfied that the Applicant has made out a case for allowing the present Civil Application.

Hence, the following order:

a) Hearing of Second Appeal no. 1122 of 2012 is expedited in the category of Senior Citizen. b) Office is directed to place Second Appeal no. 1122 of 2012 in weekly board for final hearing in the list of senior citizen, if it is ready for hearing as per its turn.

c) Civil application stands disposed off accordingly.
