The Learned Additional PP Mrs. Pai on instructions of API Mr. Salim Yusuf Khan, Wadala Police Station, states that the trial in respect of the case in question has already begun and in so far as the prosecution is concerned, witnesses have been examined and it is the I.O. who is remained to be examined. In view thereof, the relief sought by way of quashing of the proceedings being CC No.739/2011 pending before the Learned Metropolitan Magistrate 29th Court, Bhoiwada, Mumbai, cannot be acceded to. The above Writ Petition is accordingly dismissed.
