1) Heard. Applicant herein is accused in crime no. 309 of 2015 registered at Malvani police station for offence punishable under sections 498 (A), 406, 377, 504, 506 r/w 34 of the Indian Penal Code and 66 (e) of Information and Technology Act. All the offences are triable by the Magistrate. Case is registered as C.C. No. 1773/PW/2016. Charge is framed. 2) The learned counsel for the applicant submits that applicant herein happens to be permanent resident of Bahrain. That at present, her passport is
2 924.76.17 appln with Magistrate, 24th Court, Borivali. Applicant has an appointment with King Hamad University Hospital which is at Bahrain on 12/03/2017. In view of this applicant seeks liberty to travel to Bahrain from 11/03/2017 to 10/04/2017. 3) In view of this, application deserves to be allowed. Hence, following order.
O R D E R
(i) Application is allowed.
(ii) Applicant is granted liberty to travel to Bahrain from 11/03/2017 to 10/04/2017.
(iii) The learned Magistrate shall return the passport temporarily to the applicant.
(iv) Applicant shall give itinerary and all other details to the investigating agency as well as tender the same before the learned Magistrate.
(v) Applicant shall attend each and every date at the time of trial. (vi) Upon failure to attend any two consecutive dates, the learned Court shall issue non-bailable warrant and take the applicant into

(vii) The learned Magistrate shall consider expediting the trial as far as possible.
(viii) Applicant shall report to the investigating agency on 11/04/2017. (ix) Application stands disposed of.
