By a separate order passed by this Court in Second Appeal No.157 of 2019, this Court has admitted the said second appeal on the substantial questions of law formulated in the said order. Interim order passed by the Extra Joint District Judge, Niphad on 15th November, 2018 annexed at page 14 of the civil application to continue during the pendency of the second appeal. 2.

Mr.Agrawal, learned counsel appearing for the applicant on instructions from his client states that his client would not create any third party rights in respect of 99-R land which is in possession of his client during the pendency of the second appeal. Statement made by the learned counsel for the applicant is accepted as an undertaking to this Court.
