Both the parties submitted that the dispute has been settled. Memorandum Of Understanding ("MOU", for short) has been executed on 17th February, 2020. The said document stipulates that the payment would be made by the applicant to the complainant as per the schedule refected therein. On fulfillment of this MOU, both the parties have agreed to quash the proceedings, by consent. The MOU is taken on record and
rpa 2/3 923-aba-407-2020.doc marked "X" for identification. The previous application preferred by the applicant was withdrawn by the applicant vide order dated 10th February, 2020.
In view of the settlement between both the parties, custodial interrogation of the applicant is not necessary. Hence, I pass the following order:
:: O R D E R ::
(i) Anticipatory Bail Application No.407 of 2020, is allowed;
(ii) In the event of arrest of Applicant in connection with C.R.No.352 of 2019, registered with Deccan Police Station, Pune City, he be released on bail on his executing P.R. Bond in the sum of Rs.25,000/-, with one or more sureties in the like amount;
(iii) Applicant shall comply the conditions stipulated in the MOU. In the event of breach of
rpa 3/3 923-aba-407-2020.doc conditions, the complainant or the prosecution will be at liberty to initiate appropriate proceedings;
(iv) Anticipatory Bail Application stands disposed of accordingly.
