By this Writ Petition the petitioner challenges an order passed by the Industrial Court in Complaint (ULP) No. 5 of 2016 and order dated 9 th January, 2017 passed by Fourth Labour Court, Mumbai permitting amending Complaint (ULP) No. 5 of 2016.

Mr. Vaidya learned counsel on behalf of the petitioners submits that the amendment would prevent him from urging point of limitation Considering that this is a limited challenge it would be open for the petitioner to raise the point of limitation which shall be decided as a preliminary issue by the Labour Court at the time of trial.
