After arguing the matter substantially, when the Court was inclined to reject the application, learned counsel sought leave to withdraw the application and prayed that trial may be expedited. 2.

The case of prosecution is solely based on statement of prosecutrix who is alleged to be sexually assaulted by applicant on 4th April, 2017 of which report is lodged on 29th April, 2017. 3.

In that view of the matter, leave as prayed is allowed. Application is thus, dismissed as allowed to be withdrawn. However, considering the facts as aforesaid, trial is expedited. 4.

Learned Special Judge seized with special case arising out of crime No. 85/2017 to decide said case expeditiously and shall make 1/2
