The MMC was directed to file its affidavit in reply to the notice of motion taken out in the trial Court within 4 weeks from 30th March, 2015. The affidavit in reply has not been filed until now. Counsel on behalf of the MMC tenders the affidavit in reply. It is accepted by this Court. A copy of the affidavit is served upon the plaintiffs in the suit. 2.

The notice of motion has been kept for hearing by the trial Judge in the Bombay City Civil Court in Dindoshi tomorrow. Learned Judge is requested to consider the case of the parties on merits by looking into the affidavit in reply also.
