This petition challenges two notices dated 30 th January, 2017 and st January, 2017 issued by Respondent no. 1 - Assistant Commissioner of Navi Mumbai Municipal Corporation for payment of property taxes. The impugned notices are issued under the Maharashtra Municipal Corporation Act (Act) in respect of petitioner's two properties. 2.

Mr.Marne, learned Counsel appearing for the respondentCorporation on instructions states that the two notices were erroneously 1/2

907-wp-1633-2017.odt issued and therefore the same are withdrawn. However, the Corporation would examine and verify the property taxes already paid by the petitioner and/or if any property taxes are still recoverable then the Corporation will proceed to recover the same in accordance with law. 3.

In view of the statement made by Mr.Marne, learned Counsel for the respondent-Corporation, nothing survives in this petition. 4.

In the above view, petition is disposed of as infructuous. No order as to costs.
