The petitioner/member of a cooperative housing society is challenging order passed by the Appellate Authority under Section 152-A of the Maharashtra Cooperative Societies Act, 1960 rejecting appeal challenging order passed by the Returning Officer thereby rejecting petitioner'

s nomination paper on the ground that the petitioner is disqualified under Section 154-B (23). 2.

It is undisputed that list of validly nominated candidates has been published. Only stage remaining is the stage of voting. Hence, without going into the merits of the matter, at this stage no interference in the election process is called for.

Hence, by granting liberty to the petitioner to challenge the election under Section 91 of the Maharashtra Cooperative Societies Act, 1960, the writ petition is disposed of. 4.

No costs.
