The order impugned is an interim order dated 16 January 2015 passed by the Appeal Court (District Judge-2, Niphad) whereby the Application Exhibit 5 was rejected. On 10 February 2015 this Court has directed the parties to maintain status-quo till the next date in respect of suit property. That order has been continued from time to time. On 13 October 2015 the Appeal from Order was admitted and parties were directed to maintain status-quo.

Inasmuch as the Appeal is ripe for hearing, the Counsel for the parties are agreed to the following order being passed:

ORDER

i) The hearing of the Appeal is expedited.

k 2/2 52 ao 163.15 in caa as.doc ii) The status-quo order granted on 13 October 2015 shall continue to operate till the disposal of the Appeal.

iii) Needless to say that the Appeal Court shall not be influenced by the earlier orders while passing the final order. iv) The Appeal from Order is disposed of accordingly. v) In view of the disposal of the Appeal from Order, the above Civil Application does not survive and the same shall stand disposed of accordingly.
