Heard the learned counsel appearing for the respective parties. The Petitioner is challenging the notice issued under section 53(1) of the Maharashtra Regional and Town Planning Act, 1966. By the said notice, the Petitioner is directed by the CIDCO to remove the unauthorised structure on plot of land bearing Plot No.173, Karanjade, taluka Panvel, district Raigad. The Petitioner is not the project affected person. The subject plot of land was acquired by the CIDCO and allotted to one Jagdish Sudam Patil. The Petitioner has no concern with this land. Despite this, the Petitioner has made unauthorised construction without obtaining any permission from the planning patilsr 1 / 2

authority. We are, therefore, not inclined to entertain this writ petition and the same is accordingly dismissed.
