The last date of submission of the EOI Application was 22nd November, 2019. Admittedly, the Petitioners have submitted their Application only on 13th December, 2019. The Petitioners have made an Application being Misc. Application No. 4217 of 2019 before the NCLT seeking condonation of delay for submission of EOI. As of today, the Petitioners would have no locus to challenge the manner in which bid process is required to be conducted. 2.

In the circumstances, we are not inclined to entertain the Petition. The Petition is accordingly dismissed. If at all the AKN 1/2

2/2 7.wp.2086.2020.doc Application of the Petitioners before NCLT for condonation of delay is allowed and the submission of the bid of the Petitioners is accepted, it would be open for the Petitioners to fle a fresh Petition, if so advised.
