Heard learned Counsel for the parties. Both learned Counsel agree that the petition could be disposed of by this Court without indicating any reasons for the order. Accordingly, the impugned order of the Controlling Authority dated 26 May 2010 and the impugned order of the Appellate Award dated 20 October 2012, are set aside and the matter is remanded to the Controlling Authority. The Controlling Authority shall hear the parties and consider PGA Application No.110 of 2008 after permitting the Petitioner herein to cross-examine the Respondent herein on his affidavit dated 10 February 2009. After giving such opportunity to the parties, the Controlling Authority shall dispose of the application in accordance with law. The application shall be disposed of as expeditiously as possible, in any event, preferably within a Pg 1 of 2
