1) Heard. Applicant herein is accused in crime no. 309 of 2015 registered at Malvani police station for offence punishable under sections 498 (A), 406, 377, 504, 506 r/w 34 of the Indian Penal Code and 66 (e) of Information and Technology Act. All the offences are triable by the Magistrate. Case is registered as C.C. No. 1773/PW/2016. Charge is framed. 2) Applicant herein happens to be a retired police personnel from the State of Bahrain. He is the permanent residence in Mumbai. His passport is in the ism

Applicant also gives undertaking that he would not leave India without prior permission of the Court and in these circumstances, he prays for return of passport in C.C. No. 1773/PW/2016. 3) Applicant was granted liberty to travel abroad by an order dated 15/07/2015. Applicant has abided by the conditions. By an order dated 13/01/2016, this Court (Coram : A. S. Gadkar, J.) had directed the Magistrate to return the passport to the applicants as they were to travel to Bahrain from 15/01/2016 to 01/03/2016. Applicant has abided by all conditions. 4) In view of this, the learned Magistrate seized with C.C. No. 1773/PW/2016 is hereby directed to return the passport to the applicant. However, it is made clear that he shall not leave India without prior permission of the Court.

5) Application is disposed of accordingly.
