By this petition, the petitioners seeks quashing of the F.I.R. bearing C.R. No. 193 of 2019 registered with the Bund Garden Police Station, Pune City, Pune for the alleged offence punishable under Section 420 r/w 34 of the Indian Penal Code.
2. Learned Counsel for the petitioners submits that the parties i.e. the petitioners and respondent no.2 have amicably settled their 1/3
dispute. Learned Counsel for the petitioners relied on a copy of Settlement Deed which is at Exhibit D, at page no.29 of the petition, evidencing the settlement between the parties.
3. Learned APP, on instructions from PSI Mr.V.D.Jadhav, Bund Garden Police Station, Pune, submits that it is not necessary to go into the merits of the said petition in as much as, the police after investigation have filed a 'C' Summary Report before the learned J.M.F.C., Court No.1, Pune.
4. In view of the statement made by the learned APP, the learned Counsel for the petitioner, does not press this petition and seeks to withdraw the petition.
5. The petition is, accordingly disposed of, as not pressed, in view of the statement made by the learned APP.
6. It is made clear that we have not gone into the merits of the petition.

7. Needless to say that the petitioner is at liberty to file a fresh petition, if the occasion so arises.
