Mr. Sathe, the learned senior advocate for the Applicant states that approximately one year back the Respondent No.4 has closed down the Garbage processing facility. Mr. Kulkarni, the learned counsel for the Respondent No.2 on instructions states that as the Maharashtra Pollution Control Board did not grant consent, the garbage processing facility is closed down.

Hence, the application does not survive. We make it clear that if the Respondent Nos.2 and 4 propose to recommence the operation of garbage processing facility, they shall not do so without giving 15 days prior notice to the Applicant.
