Heard the learned counsel for the respective parties. 2.

The petitioner is an accused in Criminal Case bearing No.CC-370/ PW/2014 pending on the file of the Additional Chief Metropolitan Magistrate, 22nd Court, Andheri, Mumbai. On 23.10.2017 the learned Additional Chief Metropolitan Magistrate framed charge against the accused for an offence punishable under Section 325 of the Indian Penal Code. The said order was challenged by the petitioner by filing Criminal Revision Application No.325 of 2017 before the Session Court at Borivali Division, Dindoshi, Mumbai. The said revision came to be dismissed by an order dated 10.01.2017.

The allegation of the petitioner is that trial of the subject case is expedited and the charge is framed hurriedly on the basis of letter dated 12.09.2017 issued by the Registrar-I, Vigilance Department, High Court, Appellate Side, Mumbai. The petitioner alleged that the said letter is forged one, and therefore, seeking quashment of the charge framed against him.

We have perused the File No.SID-I/BY/MISC./12/2017 and after perusing the same, we found that the said letter dated 12.09.2017 was written by Registrar-I, Vigilance Department, High Court, Appellate Side, Bombay to the Additional Chief Metropolitan, Court No.22, Andheri, Mumbai. The letter is genuine, and therefore, there is no merit in the contention of the petitioner in this regard.

After charge was framed in the said case, the trial has commenced and the same is at advanced stage. We are not inclined to interfere in this petition and the same is accordingly disposed off. [N.J. JAMADAR, J.] [RANJIT MORE, J.] AGP 2/2
