By this Civil Application applicant original plaintiff is seeking to restore Civil Application (St.) No.18664 of 2018 and Appeal from Order (St.) No.18663 of 2018 which stand dismissed for non-compliance of order dated 9.8.2018 passed by this court and also for condonation of 175 days delay in filing the present Civil Application.

Considering the submissions made by the Mohite 1/2

87 caa128-19.doc learned counsel for the Applicant and the reason disclosed in paragraph nos.12 to 14, I am satisfied that the Applicant has made out a case for allowing the Civil Application. Hence, following order is passed:

A.

Civil Application is allowed in terms of prayer clause (a), (b) and (c) which reads thus:

"a) That this Hon'ble court be please to restore the appeal bearing AOST/18663/2018 and condonation of delay application bearing No.St.18664/2018 on file.

b) That this Hon'ble Court be pleased to condone the delay of 175 days in filing the present application to extend the time to remove objection.

c) Be please to extend the time of 4 weeks to remove the office objection as per order dated 9.8.2018 passed by Hon'ble Just. Mr.K.K.Sonawane."

Civil Application stands disposed of accordingly.

No order as to costs.
