This application for bail has been received through Jail. Accused is accused in Sessions Case No.339 of 2016 pending on the fle of the learned Additional Sessions Judge, (Borivali Division), Dindoshi, Mumbai. This Court vide order dated 6th April, 2018 requested the learned Sessions Judge to make an endeavour to expedite the trial pertaining Shivgan 1/3

to the Sessions Case No.339 of 2016.

The learned APP on instructions submits, prosecution had examined one witness and the next date is 17th January, 2020.

The learned Amicus Curae submits that the applicant is in custody since 2016 and the co-accused to whom similar role is attributed, has been released on bail and, therefore, on the ground of parity, this applicant may also be released on bail.

Be that as it may, in view of the fact that, prosecution has examined one witness, the learned Trial Court is requested to conclude the trial preferably on or before 15th March, 2020.

If the trial is not concluded on or before 15th March, 2020, applicant may renew request for his enlargement on bail.

Application is disposed of in the aforesaid terms. Shivgan 2/3
