Heard learned counsel for the applicant and learned APP for the State.

This is an application for bail in respect of the offence punishable under Sections 307, 326, 506(2), 323, 504, 34 of the Indian Penal Code (hereafter 'IPC' for short), under Sections 4, 25 of Indian Arms Act and under Sections 37(1), 135 of Maharashtra Police Act registered on 11.10.2022 vide First Information Report (FIR) No.1036 of 2022 with MHB Colony Police Station.

The applicant was arrested on 11.10.2022. It is the case of the informant that the applicant along with one other accused came to his residence and enquired about the informant's brother. The applicant was annoyed as the informant's brother-Harshal was having an affair with the sister of the present applicant. When the informant told the accused that his brother is not at home, the applicant took out a koyta and assaulted the informant on his head and other parts of the body. There are three simple injuries and one grievous injury.

Learned APP opposed the application for bail. 5.
The applicant is arrested on 11.10.2022 and is in custody since then. There are no criminal antecedents reported against the applicant. The investigation is complete. The charge-sheet has been filed. The applicant will face the consequences of the trial. The applicant can be enlarged on bail. Hence, the following order :-
O R D E R
(a) The application is allowed.
(b) The applicant-Akshay Santlal Yadav in connection with FIR No.1036 of 2022 registered with MHB Colony 2/3
Police Station shall be released on bail on his furnishing P.R. Bond of Rs.25,000/- with one or more local sureties in the like amount.
(c) The applicant shall attend the Investigating Officer of MHB Colony Police Station once in three months every first Monday of the concerned month between 11.00 a.m. and 1.00 p.m. commencing October 2023. (d) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not tamper with evidence. (e) On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.

The application is disposed of.
