This is an application under Section 439 of Code of Criminal Procedure for bail.

The applicant came to be arrested in Crime No. 185 of 2021 registered at Kharghar police station, New Mumbai for the ofence punishable under Section 302 of the Indian Penal Code (IPC). 3.
I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The deceased was the wife of present applicant. According to the prosecution, on 23 May 2021, the present applicant committed the murder of the deceased by strangulating her. 5.
I have perused the statement of the witness. It appears that in a sudden quarrel, the present applicant had strangulated the deceased. Prima facie, the incident does not appears to be Dinesh S. Sherla 1/2
2/2 904-ba-522-22.doc premeditated. The applicant and the deceased were married for more than 10 years. Considering the facts and circumstances of the case, I am inclined to release the applicant on bail. The applicant is permanent resident of State of Karnataka. The applicant therefore, shall furnish local sureties. In the result, the following order is passed.
O R D E R
A] Bail Application is allowed.
B] The applicant be released on bail in C.R. No. 185 of 2021 registered at Kharghar police station, New Mumbai for the ofence punishable under Section 302 of the IPC on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two local sureties in the like amount.
C] The applicant shall attend the concerned police station once in a month on frst Saturday between 11.00 a.m. to 2.00 p.m. till conclusion of the trial.
