Learned Counsel for the Petitioners on instructions of the petitioners seeks leave to withdraw the aforesaid Petition with liberty to file an application seeking the Petitioners' discharge before the trial court. He submits that during the pendency of the aforesaid Petition, charge-sheet has been filed against the petitioners.

The Petition is accordingly disposed of as withdrawn, with liberty, as prayed.

If an application for discharge is filed by the Petitioners, the learned Judge to decide the same on its own merits, in accordance with law, uninfluenced by the withdrawal of the aforesaid Petition.

We make it clear that we have not heard the aforesaid Petition on merits and as such, all contentions of the parties are kept open.
