At the outset, learned APP states that the trial has already started and the recording of evidence of the first informant is in progress.

Learned counsel for the Applicant argued the matter. But when I expressed my disinclination to grant relief, the learned counsel for the Applicant prays for unconditional withdrawal of this application. He, however, submits that Nesarikar

2 / 2 21-BA-517-20.odt considering the fact that the Applicant is in custody since 2016 and since the trial has already commenced, directions be issued to the trial Court to complete it in a time bound manner. 3.

The request made by the learned counsel for the Applicant is quite reasonable.

4. Hence, the following order :

O R D E R

(i) The application is allowed to be withdrawn unconditionally.

(ii) The trial Court shall take up this matter for further steps expeditiously and shall conclude the trial on or before on 31/12/2021. (iii) Application stands disposed of as such. (SARANG V. KOTWAL, J.)
