Heard the learned counsel for the applicant. The applicant is facing trial in Sessions Case No.841 of 2014 for the offences punishable under Sections 302, 395, 143, 145, 147, 148,149, 506(2), 120B read with Section 34 of the Indian Penal Code.

Upon perusal of the papers, it appears that the trial has commenced. The prosecution has examined more than 11 witnesses. It would not be appropriate to consider an application under Section 439 of Cr.P.C. in the midst of the trial. Hence, the application stands rejected. 3.

The learned Sessions Judge, Pune, seized with Sessions Case

Mhi BA-359-18.doc No. 841 of 2014 shall make an endeavour to expedite the trial without granting any unwarranted adjournment to the prosecution or to the complainant and shall conclude the same preferably within six months. (SMT. SADHANA S.JADHAV, J.)
