Heard learned counsel for the applicant and learned APP for the State.

I am informed that 10 witnesses have been examined. The trial is progressing. An order has already been made to expedite the trial. According to the prosecution, 150 witnesses are likely to be examined. Learned APP submits that it is not that all the witnesses will be examined. The accusation against the present applicant is that of criminal conspiracy. It is submitted by Mr. Kadam, learned counsel for the applicant that the applicant is not the assailant. On the 1/2

PMB 902.BA.455-24.doc earlier occasion an order was passed by this Court allowing the applicant to withdraw the bail application with liberty to apply after one year if the trial does not progress substantially. The period of completion of the trial has been extended by a subsequent order passed by this Court. Since the trial is progressing, learned counsel for the applicant seeks leave to withdraw this application with liberty to apply after four months.

The application is allowed to be withdrawn with liberty as prayed for and disposed of accordingly.
