Heard the learned counsel for the applicant.

Though legal heirs of deceased respondent no.2 are duly served, no one appeared on behalf of them when the matter was called out.

On 17.2.2015 this court granted four weeks time to the legal heirs of deceased respondent no.2 to file their Affidavit-in-Reply but same was not complied.

Considering the submissions made by the learned counsel for the applicant and the averments made in Civil Application, applicant is permitted to bring legal heirs on record of Mohite 1/2

6 can8-14.doc deceased respondent no.2.

Amendment be carried out within four weeks from today, failing which Civil Application shall stand dismissed without referring back to the court.

If amendment is carried out within stipulated time as stated hereinabove, office is directed to issue notice to the added respondents in Contempt Petition, returnable after six weeks.

Civil application stands disposed off accordingly.
