1) Heard. This is an application under section 438 of Code of Criminal Procedure, 1973. Applicant herein is apprehending her arrest in crime no. 11 of 2015 registered at Karjat Police Station for offence punishable under section 498 (A), 506 r/w 34 of Indian Penal Code. 2) It is the case of prosecution that son of the present applicant namely Vinit got married to Snehal, daughter of complainant on 03/02/2014. On 18/01/2014, Snehal had committed suicide by hanging in her matrimonial home. Initially, A.D. no. 3 of 2015 was registered under section 174 of Code of Criminal Procedure, 1973.

2 10.204.15 aba 3) Perused papers of investigation, more particularly, the recitals in the diary of the deceased. On the day, when she committed suicide, she has not levelled any allegations against anybody and has specifically stated that nobody should be responsible for her suicidal death. Other papers in the dairy would show that it was a love marriage. Son of the applicant could not extend any quality time for his wife. She was extremely sensitive and was still living in the dreamland. He could not fulfill her demands, however, there is nothing on record that applicant herein harassed her or ill-treated her in the capacity of mother-in-law. In view of this, applicant deserves pre-arrest bail.

O R D E R

(i) Application is allowed.

(ii) In the event of arrest, applicant be enlarged on bail on furnishing P. R. bond in the sum of Rs. 15,000/- and one or two sureties in the like amount.

(iii) Application stands disposed of.
