By this Application, the Applicants seek modification of condition Nos.2 & 3 imposed by the learned Additional Sessions Judge, Satara vide order dated 28.01.2016. The conditions of which modification is sought reads thus :- "2. The applicants be released on bail, under Section 439 of the Cr.P.C., in Crime No.165/2015, registered with the Police Station, Borgaon, for the offences punishable under Section 395, 397 of the Indian Penal Code, 1860 (the IPC) and Section 3/25 of the Arms Act, on furnishing P.R.Bond Rs.2,00,000/- each,
and one solvent surety of like amount, each.
3. The sureties must be residents of Satara District."

Learned counsel for the Applicants submits that the Applicants are residents of Rajasthan and as such, it is not possible for them to get local sureties from Satara. Learned counsel for the Applicants submits that the said condition be modified and the Applicants be directed to give sureties from anywhere in the State of Maharashtra. As far as condition No.2 is concerned, he submits that the Applicants be directed to furnish P.R.Bond of Rs.2,00,000/- each, with one or more solvent sureties in the like amount, instead of one solvent surety of the like amount.

Considering the facts of the case, the Application is allowed to the extent, that the Applicants will be released on bail on their furnishing P.R.Bond of Rs.2,00,000/- each with
one or more solvent sureties in the like amount; and the sureties can be residents of Maharashtra State instead of Satara.

The Application is allowed to the extent aforesaid. Rest of the conditions shall remain as it is. Accordingly, the Application is disposed of.
