P.C. :- By this civil application, the applicants seek extension of time to file cross-objection in the first appeal, which is already admitted. Although the delay is substantial. There is more than substantial cause shown for not filing the cross objections within the prescribed period of limitation. The applicant is stated to be suffered from Cancer and voluminous documents/medical certificates, prescriptions, treatment papers etc. have been appended. Mr. Bodke, learned counsel for the applicants, pointed out that in five connected matters as well, the delay in filing cross objections has been condoned. The appeal is pending. No serious prejudice will occasion the respondent-State, if the delay is condoned, particularly, the circumstances set out in the civil application. Accordingly, the delay is condoned. Extension is granted for filing cross-objection. The cross-objection will be considered on their own merits at the time of final disposal of the appeal. The civil application is disposed of.
