Heard Smt.Rashmi Gawade, the learned counsel for the applicant. Heard Shri V.B.KondeDeshmukh, the learned APP for the State. With their assistance I have gone through the evidence of the victim, the medical evidence and the relevant part of the judgment.

4-APPA-186-2016.doc It is submitted that the victim was in love with the applicant, and that, she was insisting that the applicant should marry her. It is also submitted that as the applicant expressed his inability to marry her, the victim lodged a false report against him. It is also submitted that the testimony of the victim is not reliable, and that, the same does not get any support from the medical examination.

However, that the victim, at the material time, was below 18 years of age, is not in dispute.

Considering all the relevant aspects of the matter, though I am not inclined to suspend the sentence imposed upon the applicant, it would be proper to expedite the hearing of the appeal.

The application is rejected.
