The present application is filed challenging the Order dated 7.12.2015 thereby rejecting the application for discharge by the applicant. The learned Special P.P. on instructions submitted that during the pendency of the present application charge has now been framed on 7.6.2016 and the present application has become infructuous. In view of the same, the learned Counsel for the applicant on instructions seeks leave to withdraw the present application with liberty to adopt appropriate proceedings challenging the order of framing of the charge. Leave and liberty granted.
