IN THE HIGH COURT OF JUDICATURE AT BOMBAY
CIVIL APPELLATE JURISDICTION CIVIL APPLICATION NO.154 OF 2015 IN CIVIL REVISION APPLICATION (STAMP) NO.3800 OF 2015 Smt. Shalan Maruti Girme .. Applicant
Versus
Shri. Shankar Dattatraya Girme and others .. Respondents Shri. Vikas B. Shivarkar, for the Applicant.
CORAM : R.M. SAVANT, J.
DATE : 09th MARCH, 2015 P.C.
1.
The above Civil Application has been filed for condonation of delay of 45 days in filing the Civil Revision Application. However, having regard to the challenge raised in the Civil Revision Application, the Petitioner would have to file a Writ Petition challenging the impugned order as the said order is an interlocutory order in a land reference proceeding pending before the District Court. By the said order the Applicant's application for being permitted to lead evidence is rejected. Hence, there is no warrant to consider the Civil Application for seeking condonation of delay. The Civil Application is accordingly disposed of in view of the fact that the Civil Revision Application itself is not maintainable.
