Since the Order dated 16th December, 2020 passed by this Court (Coram : K.K. Tated and N.R. Borkar, JJ.) was not complied with by Respondent No.1 till date, this Court by its order dated 9th July, 2021 directed the Respondent No.1 to file an AfÏdavit of the ofÏcer responsible for such non-compliance, explaining as to why action should not be taken against him for not complying with the directions given/recorded in the said order. Today, an AfÏdavit dated 14th July, 2021 is filed by the Joint Secretary of Revenue and Forest Department, Mantralaya, Mumbai, wherein after tendering an unconditional apology at the outset, the Joint Secretary has submitted that the order dated 16th December, 2020 was not communicated to the Minister (Revenue). 2 / 2 6-WP-1273-2021.odt accept the unconditional apology tendered by way of the said AfÏdavit and we are of the view that the Minister (Revenue) should conduct an enquiry as to why the Order of this Court giving specific directions to the Minister (Revenue) was not communicated to his ofÏce and take appropriate steps to ensure that such conduct is not repeated again.

The Minister (Revenue) shall comply with the order dated 16th December, 2020 in its entirety and pass his final order in Revision Application No. 2513 of 2016 within a period of four weeks from today by conducting a fresh enquiry. The above Writ Petition is accordingly disposed off.
