When the matter was called out, Counsel appeared and said Mr. Ganbavale is appearing for petitioners. Counsel did not have any idea what the matter was about and was unable to even answer basic questions.

We kept back the matter with a direction to the Counsel to inform Mr. Ganbavale to remain present in Court. We were informed that Mr. Ganbavale is before another Court and his matter was at Serial No.22 in that Court. As we could see from the indicator, Serial No.7 was going on. When the matter was called out again, Mr. Ganbavale did not turn up. It also does not appear that Mr. Ganbavale has filed Vakalatnama and Mr. Lohankar is also not able to say whether Vakalatnama has been filed.

Petition therefore, dismissed.

At 2.30 p.m. :- 4.

Mr. Ganbavale appeared before the Court and expressed his regret for not remaining present when the matter was called out and prays for restoration of the petition.

Petition is restored to file.

Mr. Ganbavale states that petitioner no.2 has died and that before the next date he will take steps to bring his legal heirs on record.
