By this petition, the petitioner seeks quashing of the FIR bearing C.R. No. 52 of 2014 registered with the Malad Police Station, Mumbai, for the alleged offences punishable under Sections 354A, 323 and 504 of the Indian Penal Code.

Learned Counsel for the petitioner submits that the police after investigation have filed a 'B' Summary Report on 31st August 2015 and 10th December 2015 in the said C.R. He submits that the report is still pending before the concerned Court. N. S. Chitnis 1/2

Considering that 'B' Summary Report has been filed in the aforesaid C.R., nothing survives for consideration in this petition seeking quashing of the FIR.

Petition is disposed of accordingly with liberty to the petitioner to file a fresh petition/application, if the occasion so arises. We also direct the concerned Court to pass appropriate orders on the 'B' Summary Report filed by the police, as expeditiously as possible, and in any event within 8 weeks from the date of receipt of this order.
