This is an application for bail in C.R. No. 206 of 2018 registered with Jogeshwari Police Station, Mumbai on 14th December, 2018 for offences under Sections 406, 420, 465, 468, 471, r/w Section 34 of Indian Penal Code.

The grievance of the complainant is that from 20152018, the accused Sadhana Gavnang, Shashikanat Pimpalkar and Manoj Jadhav (applicant) had promised the complainant that room premises from Mhada would be allotted to her and with this assurance, the amount of Rs.4 Lakhs was parted by her to the accused persons. The accused had also handed over false allotment letter to the complainant. The applicant has been arrested on 15th Sajakali Jamadar

Learned counsel for the applicant submits that the coaccused Shashikanat Pimpalkar has been granted bail by this Court. Further detention of the applicant is not necessary. 4.

Learned APP submitted that the FIR indicates that the amount was handed over to the applicant and the co-accused. However, considering the fact that the applicant is in custody from 15th September, 2020, and the offences are triable by the Magistrate, there are no criminal antecedents against the applicant, bail can be granted to the applicant.

ORDER

(i) Criminal Bail Application No. 720 of 2021 is allowed; (ii) The applicant is directed to be released on bail in connection with C.R. No. 206 of 2018 registered with Jogeshwari Police Station, Mumbai on executing P.R. Bond in the sum of Rs.25,000/- with one or more sureties in the like amount;

(iii) The applicant shall report concerned Police Station once in three months on first Saturday of the month between 11:00 a.m. to 1:00 p.m. till further order;
