Learned A.P.P., on instructions from Superintendent, Nashik Road Central Prison, Nashik, submitted that, when the Petitioner was released on Covid-19 emergency parole leave, he expired on 25th January 2022 due to accident on railway track and the Medical Officer attached to Chhatrapati Shivaji Maharaj Hospital at Kalwa, District Thane has issued Medical Certificate dated 26th January 2022 in that behalf. A photocopy of the said Certificate along with Report dated 25th January 2023 is produced on record. 2.

In view thereof, present Petition is abated and is accordingly disposed off.
