Heard the Learned Advocates for the parties as well as the parties who are present in Court and the following order is passed, by consent. (i) The Matrimonial Petition No.A-222 of 2016 filed by the Respondent-husband seeking dissolution of marriage between the Applicant and the Respondent and pending before the Family Court at Thane is transferred to the Family Court at Bandra, Mumbai.
(ii) The Applicant-wife has filed M.J. Petition No.A-1750 of 2016 seeking judicial separation before the Family Court at Bandra and the same is pending. (iii) The Applicant and the Respondent have two daughters. The elder daughter is nine years old and is residing with the Respondent father. The younger daughter is two years old and is residing with the Applicant mother. The Applicant is given access to elder daughter and the Respondent is given access to the
kpd 2 / 2 925-MCA-56-2017.sxw younger daughter on the first and third Saturday of each month in the premises of the Family Court at Bandra between 2.30 p.m and 5.30 p.m. The said timings shall now be between 3.30 p.m. and 6.00 p.m.
(iv) The Learned Judge hearing the Matrimonial Petition Nos. A-222 of 2016 and A-1750 of 2016 shall place the matters for hearing on the 1 st and 3 rd Saturday of each month at 3.00 p.m. sharp and shall not grant any adjournments unless absolutely necessary. The Learned Judge shall endeavour to dispose of Matrimonial Petition Nos. A-222 of 2016 and A-1750 of 2016 within a period of six months from the date of this order.
(v) The parties shall appear before the Principal Judge, Family Court at Bandra, Mumbai on 23 rd August, 2017 at 3.00 p.m. and obtain necessary orders/directions.
(vi) All the contentions of the parties are kept open. (vii) The above Miscellaneous Civil Application is accordingly disposed off.
(viii) Liberty to apply.
