This is an application for suspension of sentence imposed upon the applicant by the learned Magistrate, 13th Court, Dadar, by its order dated 19.7.2013. By the said Judgment and order the applicant is convicted under Section 279, 337 and 304A of the Indian Penal Code and has been sentenced to suffer simple imprisonment for one month and to pay a fine of Rs.500/- in default to suffer simple imprisonment for five days. The appeal preferred by the applicant has been turned down by the Special Judge,City Civil and Sessions Court, Greater Mumbai by Judgment and order dated 18.1.2016. As the maximum sentence imposed upon the applicant is of one month, the substantive sentence imposed upon the applicant is hereby suspended during the pendency of the present revision application. 2) The applicant be released on his furnishing PR bond in the sum of Rs.15,000/-with one or two solvent local sureties in the like amount. 3) Application is allowed in the aforesaid terms.
