Heard learned Counsel for the parties.

The only grievance of the learned Counsel for the petitioner is that although, arguments in the Protest Petition filed by the petitioner, had concluded on 24th December, 2020, till date, the learned Magistrate has not passed any order on the same. Thus, the petitioner prays that the Protest Petition filed by the petitioner challenging the "C" Summary Report filed by the Investigating Officer in connection with C.R.No.163 of 2018 registered with the Vimantal Police Station, Pune, be disposed of, in a time bound manner.

Perused the papers. It appears that an FIR was lodged by the petitioner in the year 2018 and that after after investigation "C" Summary Report was filed by the Police on 26th November, 2019. Pursuant to the said Report, the petitioner filed a Protest Petition. The only grievance of the petitioner is that on 24th December, 2020, the learned Judge heard arguments, however, till date, no order has been passed. 4.

Considering the aforesaid, it would be appropriate to direct the learned Judicial Magistrate First Class, Pune, to decide the Protest Petition filed by the petitioner, as expeditiously as possible and in any event, within eight weeks from the date of receipt of this order, in accordance with law. All contentions of all parties are kept open. 5.

The petition is accordingly disposed of on the aforesaid terms. 6.

Learned Counsel for the petitioner to place the order passed today before the learned Judicial Magistrate First Class, Pune, so as to enable him to comply with the same.
