This is an application fled under Section 439 of the Code of Criminal Procedure, 1973 for grant of bail. 2.

The applicant came to be arrested in Crime No. 139 of 2021 registered at Shikrapur Police Station, Pune for the ofences punishable under Sections 420, 409, 465, 467, 468, 471, 120-B of Indian Penal Code.

According to the prosecution, the present applicant and other co-accused in connivance with each other defrauded the Shivajirao Bhosale Sahakari Bank to the tune of Rs.2.10 crore. 4.

This Court on 16 March 2023 passed the following order:

"1.

The learned Counsel for the applicant, on instructions, submits that the applicant without prejudice to his rights is willing to deposit amount of Rs.3,00,000/- (Rupees Three Dinesh S. Sherla 1/2

3-ba-417-23.doc Lakhs) within a period of one week from today. The applicant is permitted to deposit the said amount with the Liquidator of the concerned bank.

List the present application on 27 March 2023 at 2.30 p.m."

The learned counsel for the applicant submits that pursuant to the above order, the applicant has deposited an amount of Rs.3 lakhs. The main accused is already released on bail. Considering the facts and circumstances of the case and as the applicant is in Jail for more than one year, I am inclined to release the applicant on bail. Hence, the following order is passed :

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No. 139 of 2021 registered at Shikrapur Police Station, Pune for the ofences punishable under Sections 420, 409, 465, 467, 468, 471, 120-B of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
