The Petitioner challenges the order passed by the Civil Judge Junior Division, Sinnar dated 27 November 2012 rejecting the application for appointment of Deputy Superintendent of Land Records as Court Commissioner.

Heard learned counsel for the Petitioner. It is not necessary to interfere with the impugned order as the learned Civil Judge has kept the remedy of the Petitioner to approach the superior authorities for 'Nimtana' measurements. The learned Civil Judge has observed that the measurement carried out by TILR / Deputy Superintendent of Land Record is already on record and if the Petitioner is aggrieved he can apply for Nimtana measurements. Needless to state that in view of this liberty, if application is so made by the Petitioner, the revenue

2 18 WP 9550-16 doc.doc authorities will act upon the same and carry out the Nimtana measurements. Writ Petition is accordingly disposed of by the above said clarification.
