The applicant herein has sought to condone the delay in filing this application and further to restore the First Appeal (St.) No.18665 of 2018, which was dismissed for non removal of office objections. 2.

By order dated 26/11/2018, four week'

s time was granted to the applicant to remove office objections. The applicant was put to notice that failure to remove office objections would result in refusal of the registration of the appeal. Non-removal of office objections has 1/3

resulted in the dismissal of the first appeal. 3.

Mr. Sarthak Diwan, the learned counsel for the applicant states that the office objections will be removed within a period of four weeks.

In the light of said statement and in view of the reasons stated in paragraph 7 of the application, delay is condoned. First Appeal (St.) No.18665 of 2018 is restored to file subject to removal of office objections.

Civil Application No.3421 of 2019 stands disposed of. 6.

The learned counsel for the applicant further states that the applicant - insurance company has already deposited the compensation as per the impugned judgment and award before the Claims Tribunal, Thane.

In the light of said statement, execution and implementation of the impugned judgment and award is stayed till the next date of hearing.
